These terms apply to your use of this website and to your enquiries to us. Work we carry out for a client is governed by a written agreement made for that work, as described below.
Who we are
This website is run by Peak Momentum, operated by Babson (“we”, “us”). We are a remote first agency. You can contact us at babson@peakmommentum.online. Our working hours are Mon - Fri 9AM - 7PM, and we aim to respond within 24 hours.
Business customers only
Our services are for businesses and organisations. We do not offer them to consumers, and by contacting us about our services you confirm that you do so for the purposes of a business.
Information on this website
The automations described on this website are a general description of what we offer. They are not a contract or an offer capable of acceptance. What we build for you depends on your business and your tools, and is set out in the agreement we make with you.
We take care to keep this website accurate, but we do not promise that it is complete or free from error. We do not promise any particular business result, such as more enquiries, bookings, reviews or revenue.
Working with us
Before we start work, we will agree the following with you in writing, which can be by email:
- which automations we will build and what each one will do;
- the fee, how and when it is paid, and any ongoing charges;
- who provides and pays for the third-party tools the automations use;
- how long the agreement lasts and how either of us can end it.
If anything in our written agreement conflicts with these terms, the written agreement applies.
Your responsibilities as a client
- You are responsible for the messages we send in your name once you have approved them.
- You must have a lawful right to contact the people whose details you give us, and must follow the rules on calls, texts and email marketing that apply to you and to them, including consent and opt-out requirements.
- You must give us accurate information and the access to your tools that we reasonably need.
- Automations that use artificial intelligence can make mistakes. You should review how they perform, especially in the first weeks, and tell us promptly if something is wrong.
Third-party services
Our automations may rely on services we do not control, such as telephone, messaging, email, calendar and CRM providers. We are not responsible for outages, changes or charges from those providers.
Intellectual property
The content of this website, including its text, design and logo, belongs to us or is used with permission. You may view it and share a link to it, but you may not copy or reuse it for another business without our written permission. Ownership of work we create for a client is set out in the agreement with that client.
Our liability
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, and liability for fraud or fraudulent misrepresentation.
Subject to that, we are not liable for loss of profit, revenue, business or goodwill, or for indirect or consequential loss, arising from your use of this website. Our liability for work done for a client is set out in the written agreement with that client.

This website may link to other websites. We do not control them and are not responsible for their content or privacy practices.

How we handle personal information is explained in our privacy policy.
Changes
We may update these terms from time to time. The date at the top of this page shows when they were last changed. The version on this website when you contact us is the one that applies to that contact.
Governing law
These terms, and any dispute arising from them or from your use of this website, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that nothing in these terms stops either of us from bringing a claim in a court elsewhere where the law requires it.
